Great Caribbean Cruise Giveaway — Official Rules
Eligibility
Contest entrants must be at least 21 years old as of March 1, 2008,
and a legal resident of the United States. This contest is sponsored by
AVC Communications and All Ways 2 Travel. Employee’s owners or
management of either company, their affiliates, advertising and
production agencies related to this contest, and their respective
household members are not eligible. All federal, state, and local laws
and regulations apply. Void wherever prohibited or restricted by law.
Registrants can only win ONE prize and become a finalist during the
promotion. Registrants who have already won a prize and/or become a
finalist are NOT eligible to register again during this contest. Only
ONE member of each household can become a finalist in the contest.
How to Enter
No purchase is necessary. Contest begins on January 1, 2008, at
12midnight Eastern Time and ends at a date to be determined in March,
2008. ("entry period.") You may enter this contest during the Entry
Period by visiting any sponsor designated as a registrant and completing
the registration form. Registrants can register weekly at each
participating sponsor. Registrants can only win ONE prize and become a
finalist during the promotion. Registrants who have already won a prize
and/or become a finalist are NOT eligible to register again during this
contest. Only ONE member of each household can become a finalist in the
contest.
Selection of Winners
(Individual Prizes)
Winners/Finalists will be selected in random drawings from among all
eligible entries received during the Entry Period on a weekly basis.
Prize drawings will be conducted by sponsors at their locations. Winners
will be notified by phone, U.S. mail, or e-mail and will be required to
sign an Affidavit of Eligibility/Liability Release and where legal, a
Publicity Release, within 14 days of notification attempt. Failure to
return the affidavit in the time noted will result in disqualification
and an alternate entrant will be selected. Any prize not accepted may be
forfeited for future use by AVC or returned to the prize donor.
Selection of Grand
Prize Winner
Winner will
be selected in a random drawing from among all eligible entries
(Finalists only) from previous drawings during the Entry Period. Prize
drawing will be conducted by AVC Communications on a date, time, place
to be determined in March, 2008. Finalist or there designated substitute
MUST BE PRESENT at the drawing to be eligible and win!
Odds of Winning
Odds of winning depend upon the number of eligible entries received.
Entry constitutes permission (except where prohibited by law) to use
winners' name, hometown and likeness for publicity purposes without
additional compensation.
Limit of Entry
All members of a household that meet the eligibility requirements can
enter the contest for weekly prizes and to become a finalist. Only ONE
member of each household can become a finalist in the contest. By
entering, entrants acknowledge compliance with these official rules
including all eligibility requirements. AVC Communications is not
responsible for delayed, lost or misdirected entries, delays in mail or
other services, or failures in technology such as but not limited to:
technical malfunctions, lost/delayed data transmission, line failures of
any telephone network, computer equipment, software, inability to access
any Web site or online service, inaccurate transcription of entry
information, or for any human error, or misdirected entries. Entry
materials that have been tampered with or altered are void. No copies,
facsimiles or reproductions of registration materials or entry form
will be accepted.
Grand Prize
One (1) roundtrip 3 day Caribbean cruise for two (2) aboard a Carnival
Fun Ship. Prize includes accommodations for the cruise winner and guest,
all regular onboard meals and entertainment. Roundtrip airfare,
transfer to pier and government taxes and fees. Excludes all holiday
cruises. Charges of a personal nature, including, but not limited to
gratuities, phone calls, shore excursions, gift shop purchases, spas,
etc., are the sole responsibility of the winner. Prize is
non-transferable, cannot be substituted, combined with any other offer
or redeemed for cash. Prize can be upgraded at the prize winner’s
expense. A total credit of $1,100.00 will be applied to the winners
chosen itinerary. All travel must be booked through All Ways 2 Travel at
least 60 days in advance of the cruise or additional costs will be
charged to the winner. All travel is subject to space availability.
Blackout dates including holidays and other restrictions may apply.
Travel must be completed by March 30, 2009. All taxes on the prize,
including but not limited to income and sales taxes, are the
responsibility of the winner.
Other Important Points
Contest participants, by entering, release AVC Communications and All
Ways 2 Travel and their respective parents, affiliates, directors,
employees and agents from any liability with respect to the receipt or
use of this prize and agree to be bound by the 2008 Cruise Contest
Official Rules. AVC Communications and All Ways 2 Travel makes no, and
disclaims, all warranties, guarantees or representations, express or
implied, concerning the condition, quality, merchantability, of this
prize. For the name of the prizewinner, send a stamped, self-addressed
envelope before August 31, 2008 to: Cruise Contest Winner, AVC
Communications, PO Box 338, Cambridge, OH 43725.

Disputes
Entrant
agrees that: (i) any and all disputes, claims and causes of action
arising out of or connected with this Contest, or any prizes awarded,
other than the administration of the Contest or the determination of
winners shall be resolved individually, without resort to any form of
class action, and exclusively by the United States District Court for
the District of Ohio or the appropriate Ohio State Court ; (ii) any and
all claims, judgments and awards shall be limited to actual
out-of-pocket costs incurred, including costs associated with entering
this Contest but in no event attorneys' fees; and (iii) under no
circumstances will entrant be permitted to obtain awards for and entrant
hereby waives all rights to claim punitive, incidental and consequential
damages and any other damages, other than for actual out-of-pocket
expenses, and any and all rights to have damages multiplied or otherwise
increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION
OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY
NOT APPLY TO YOU. All issues and questions concerning the construction,
validity, interpretation and enforceability of these Official Rules, or
the rights and obligations of the entrant and Sponsor in connection with
the Contest, shall be governed by, and construed in accordance with, the
laws of the State of Ohio, without giving effect to any choice of law or
conflict of law rules (whether of the State of Ohio or any other
jurisdiction), which would cause the application of the laws of any
jurisdiction other than the State of Ohio.
