Libertarian Party fights back after defeat in Supreme Court

COLUMBUS, Ohio (AP) - Ohio Libertarians continue to fight for ballot access for their gubernatorial candidate after another legal defeat at the U.S. Supreme Court.

Justice Elena Kagan has denied the Libertarian Party of Ohio's request to block a federal court's decision keeping candidate Charlie Earl from Tuesday's ballots. Mark Brown, the party's attorney, said he re-filed the request with Justice Clarence Thomas on Friday.

Secretary of State Jon Husted disqualified Earl after Earl's nominating petitions were challenged. Husted agreed with a hearing officer who found that two Earl petitioners failed to properly disclose their employers.

The party appealed to the 6th U.S. Circuit Court of Appeals in Cincinnati, which sided with Husted Thursday.

Libertarians argue that requiring petitioners to declare their employers is a violation of their First Amendment rights.
