Libertarian Candidate Denied

Written by

COLUMBUS, Ohio (AP) - The Ohio Supreme Court has denied a request from a Libertarian candidate who was seeking to force the state's elections chief to place his name on primary ballots.
Last month, Secretary of State Jon Husted disqualified attorney general candidate Steven Linnabary from the May 6 ballot.  Linnabary's nominating petitions were successfully challenged on two grounds: that a signature gatherer failed to comply with Ohio law requiring that he be either Libertarian or politically independent and another requirement that he disclose his employer.
Linnabary's attorneys said the man who protested the petitions lacked the standing to do so. They also argued that the state law does not require certain petition circulators to disclose employment because they are independent contractors.
The high court said Thursday that Husted reasonably interpreted the law.

Potential Landmark Gay Marriage Ruling

Written by

CINCINNATI (AP) - Civil rights attorneys are arguing that a federal judge should prohibit Ohio officials from enforcing the state's ban on gay marriage.
The attorneys will deliver closing arguments in the matter Friday before federal Judge Timothy Black in Cincinnati.
Their request goes far beyond their original and narrow February lawsuit asking Black to force Ohio to recognize gay marriage on birth certificates.
They're now asking Black for a ruling that would effectively strike down the state's gay marriage ban, passed by voters in 2004.
Attorneys for the state argue Ohio has a sovereign right to ban gay marriage and has the right to refuse to recognize same-sex marriages legally performed in other states.
In a limited ruling in December, Black ordered Ohio to recognize gay marriage on death certificates.
